There are various approaches made to what may constitute an HMO.
HMO could refer to a building or part of a building such as a flat, where a particular test maybe applied to establish in what form the HMO may fall. It could be a flat in multiple occupation !
There are exemptions and detailed criteria to assess in order to reach a decision as to whether a building can be deemed a House in Multiple Occupation.
Should there be a disagreement between interested parties as to HMO status, the case can be referred to a Residential Property Tribunal.
As well as Mandatory Licensing, local housing authorities have also been given powers to add additional licensing to the whole or part of their districts. This could include a requirement to licence other HMO's which may include: flats in multiple occupation, single or two storey dwellings.
For HMO Licensing purposes other criteria are considered for example:
Is the HMO three storey or above? Storeys can include a habitable basement, a commercial premise on the ground or other floors, or converted attic space.
Are there five or more tenants?
Is there two or more households sharing a basic amenity?
